TRAVELLER TERMS & CONDITIONS
GENERAL
These general Terms and Conditions form an integral part of the contract concluded between JOYA CYPRUS TOURISM representing Crystal Bay Marina, Crystal Bay View and Crystal Bay Village resorts (hereinafter referred to as "The Company") and the Guest, whether or not concluded through the Company's website. JOYA CYPRUS is used as the ‘trading name’ and is a legal entity and is part of the Evergreen Developments group, and Joya Cyprus Tourism Services Ltd is a legally registered limited company in the Turkish Republic of Northern Cyprus (hereinafter referred to as the ‘TRNC’). All terms and conditions, in addition to any changes or additional rules and regulations, are at the discretion of the Management or as implemented by the Local authority or Government in which The Company must adhere to although not yet published on the website.
AVAILABILITY
All accommodation offered by The Company whether at Crystal Bay Marina, Crystal Bay Village or other holiday rental property in the TRNC (hereafter known as the ‘Resort’) are subject to availability and the discretion of The Company Management. Priority will be given to accommodation that was paid for at the moment of reservation, followed by accommodation that has been reserved by a deposit payment.
RESERVATION
For reservations made through our websites (www.joyacyprus.com ), the Guest must provide, amongst other things, a valid e-mail address on the reservation form. The Company takes no responsibility for the consequences of any incorrect information submitted by the Guest.
Once the payment has been verified, The Company sends a confirmation e-mail with details of the transaction to the Guest, which must be retained for check-in purposes. Reservations are not final until the confirmation e-mail has been sent.
LATE CHECK OUT / DAY USE
Late checkout or Accommodation during the day ("day use") is subject to the availability of rooms on that day, and is only possible between 9h00 and 16h00. Reservations for day use will be taken into account at the earliest moment possible on the day prior to the day of arrival. In case of departure after 16h00, a supplementary overnight accommodation shall be charged.
CHECK IN / CHECK OUT
Guests must present a valid personal ID or Passport when checking in.
Accommodation is made available to Guests as from 14h00. Guests who wish to have access to their room before 14h00 must inform The Company in advance and obtain a written confirmation from The Company. In such case, a supplementary fee may be charged.
Guests must check out before 10h00 on the day of departure. All late departures between 10h00 and 12h00 must be notified to the reception and shall be charged in accordance with the current advertised rates. Up to one night's accommodation may be charged in case of departure after 12h00.
RENUNCIATION, CANCELLATION and REDUCTION IN NIGHTS BOOKED
Guests have the right to cancel or change their Reservation before arrival, by written notice to The Company.
Refunds where detailed in the Cancellation policy appropriate to the reservation are provided as a credit to the credit card used at the time of your reservation if a written cancellation or request for reduction is sent at least 30 days in advance of arrival to info@joyacyprus.com. All refunds made will be subject to the cancellation charges made by us plus any Bank charges incurred due to exchange rates or other charges applicable and will be made after 30 days of the cancellation being confirmed. Any changes made after a confirmed booking is received must be made in writing to the aforementioned email address and is subject to and at the discretion of The Company, and the request being made is within The Company’s control to accept such changes. The Company reserves the right to charge for such changes if applicable.
CANCELLATION CHARGES
After confirmation of payment, cancellation charges applicable will be as follows:-
For payment in full at the time of reservation – No refund will be given in the event of cancellation
For reservations made with deposit payment – No refund will be given, and no balance will be due. There will be no further cancellation charge.
No-shows – No refund
For reductions in the number of nights booked – minimum stay varies at each resort but is never less than 2 nights. Reductions can not be made lower than 2 nights. If a booking is reduced, the refund will be processed at the time of arrival when the reservation has been secured by a deposit. Where a booking was paid in full, the reduction refund will be processed within 30 days of the written notification.
The Company recommends that suitable Insurance cover for all eventualities be taken out by all Guests prior to travelling and prior to making any reservation. The Company is not liable or responsible in any way if exclusions within any Insurance cover does not allow or cover for such eventualities.
PRICE
Prices are shown per accommodation (apartment/Villa) and per night, for the number of persons and dates indicated. All prices include taxes (VAT included). The displayed prices do not include supplements (for example additional room facilities, excursions, car hire or any other services), expenses incurred at The Resort, including, without limitation, use of minibar, safety deposit box, external phone calls, room service, meals (other than those stated at the time of reservation), personal travel insurance, items of personal expenditure, bar, restaurant, laundry, etc etc unless otherwise stated.
The Company does not grant credit for the services it provides and the goods it sells. All expenses incurred during the stay, including the bar, restaurant, laundry, phone and others, must be paid immediately before checking out of the accommodation, or upon request and demand by the Company.
Guests must pay their reservation deposit or full balance payment whichever is the chosen option during the booking process within three (3) days of the reservation being approved. If the deposit payment is not paid, or the credit/card details are invalid the reservation request will automatically be cancelled.
The Guest may address The Company in writing (by mail or by e-mail) to request different payment conditions. The Company reserves the right to accept or reject such conditions. Without prejudice to any terms and conditions expressly agreed upon by the Guest and The Company in writing, The Company reserves the right to cancel all reservations which have not been paid within the allowed term.
The Company accepts payments in cash, by bank transfer or by credit card. Payments by cheque are not accepted.
The Guest may contact any affiliated booking agency of The Company to obtain information regarding advances and advanced payments: Please see the contact details of your booking agent. The booking agent will inform the Guest on the steps to be taken and will provide the bank details of The Company.
RESERVATIONS BY COMPANIES OR ORGANISATIONS BENEFITING FROM A SPECIAL AGREEMENT
All reservation requests, whether by phone, mail or e-mail, made by companies or organisations that have concluded a special agreement with The Company, must be confirmed by an order form, if The Company has granted credit facilities to this company or organisation.
If no agreement was concluded with respect to credit facilities, the standard guest payments conditions shall apply. After expiry of the three (3) day term provided, the reservation will be cancelled and The Company will re-enter the booked accommodation into the number of accommodation units available to guests.
Credit facilities will be granted provided that all overdue amounts are paid within thirty (30) days of receipt of the invoice. In case of failure to comply with this provision, The Company may demand payment in advance of the total amount for all future reservations.
The Company reserves the right to cancel any reservation in case of failure to comply with this clause 9.
RESPONSIBILITIES OF THE COMPANY
The Company shall be liable for damage resulting from its wilful intent or gross negligence, or that of its representatives and agents, or resulting from its failure to comply with its material obligations under this agreement.
The Company shall not be liable for any deterioration, destruction or theft of those objects that can be imputed to the Guests or people accompanying, visiting or serving him, that result from armed robbery or that result from the nature or defects of the object.
The Company's responsibility for all other cases than those exhaustively indicated above, shall be limited to the price paid by the Guest for his reservation.
The Company does not accept any liability for destruction or theft of vehicles parked on the Company's premises, for services rendered by third parties to Guests, even if those services were organised by The Company, for damage, losses, expenses and any other sums which did not result from any breach of contract or other fault by The Company or, where The Company is responsible for them, of its employees, agents or suppliers.
In any event, the Guest must immediately notify The Company of any discovered damage, in order for his claim to be admissible.
Furthermore, The Company cannot be held responsible for any facility that may not be available due to any circumstances beyond its control, or due to yearly maintenance or is unavailable due to breakdown or due to other factors unforeseen by The Company.
GUEST RESPONSIBILITIES
The Guest shall be liable for damage caused by his act, omission or negligence. If the damage is discovered after the Guest has left, The Company reserves the right to charge the Guest's credit card with, or to send an invoice for, the amount required to repair any such damage.
Every booking has an allowance per day for electricity. Guests exceeding this allowance will be charged for this excess as per The Company Utility Policy stated on the Registration card and signed for at the time of check-in. If this is not settled before check out The Company reserves the right to charge the Guest’s credit card with, or to send an invoice for, the amount due.
FORCE MAJEURE
The Company is not liable and shall not owe any compensation or damages if it is unable to fulfil its contractual obligations due to force majeure, or if the Guest suffers damage as a result of a force majeure event. For the purposes of this clause, "force majeure" shall mean all facts and circumstances which The Company could not reasonably foresee or prevent, such as, for example, natural or nuclear disaster, war or the threat of war, terrorist activities or the threat thereof, strikes, civil unrest, floods, fires, earthquakes etc etc.
PERSONAL DATA
For all information regarding the treatment of personal data, the Guest is referred to The Company's Privacy Policy, which constitutes an integral part of these general conditions.
APPLICABLE LAW AND JURISDICTION
These general conditions are governed by TRNC law. The Company and Guest submit to the exclusive jurisdiction of the courts of TRNC, to settle any dispute which may arise out of or in connection with these general conditions.
RESERVATION TERMS AND CONDITIONS FOR ONLINE BOOKINGS
1. Reservation information
Any credit card details supplied for the purpose of an agreed payment will be charged instantly, should the transaction be successful the reservation will be confirmed and the deposit posted onto your reservation.
All major credit cards will be accepted.
Credit Card - the credit card details supplied with each reservation will be billed immediately as specified. All other extras will be settled by each guest on their departure.
The card used to make a reservation will not be required to be presented at the time of check in. In the case of bookings made by deposit, any form of payment is acceptable upon arrival to clear the balance remaining. All incidentals will be paid for by the guest on their departure.
Comments and queries with regard to payments should be emailed with full booking details to The Company or to the relevant agent concerned with the booking.
You agree that this transaction constitutes an electronic transaction as defined in the Electronic Communications and Transactions Act 2002 (as amended) and that a binding agreement has been concluded between Joya Cyprus and you in terms of which you authorise Joya Cyprus during the process of a reservation being made and subsequently approved to deduct from, or to debit, the credit card for the amount owing for services rendered or to be rendered and that your written signature shall not be required for authorisation purposes.
All accommodation provided in terms of any reservation made on this website will be subject to the standard Joya Cyprus terms and conditions of residence of the Resort concerned. By clicking the "Payment " button, you signify and accept all terms and conditions contained in this website.
2. Rate information and availability
Rates on offer on this site are only available in respect of online reservations.
Rates are subject to availability, possible fluctuations over special events or peak periods and are subject to review. Rates given for a 1 bedroom apartment are based on 2 people sharing an apartment and are charged per apartment per night unless otherwise indicated. Rates given for a 2 bedroom apartment are based on four persons sharing an apartment and are charged per apartment per night unless otherwise stated. Rates given for 3 bed apartment are based on 6 people sharing. Rates for other accommodation types are for the number of people stated in the accommodation description.
Rates are for accommodation only and inclusive utility allowance, and are inclusive of VAT (unless specifically described in the room description.
You will be charged for the accommodation for the original reservation that is processed online at the time of making the reservation. Any amendments to the original reservation resulting in changes to your accommodation will be subject to further invoicing or payment request by other means.
Certain special promotions carry their own rates and terms and conditions, which apply and will be charged accordingly.
3. Seasonal variations in rates
Joya Cyprus distinguishes 2 different periods with regard to rates for bookings determined as "low season and peak season” Should your booking span two different seasons the different rates will be applied according to the number of nights within each season.
4. Payment terms and conditions for bookings during all seasons
If a reservation is extended at request online The Company will take payment in respect of the additional accommodation charges at the time of check-in.
If you reduce the number of nights stay and the arrival date is within 30 days of arrival, any reduction that may be due from the expected balance will be processed at the time of check-in at the hotel.
If you reduce the number of nights stay and the arrival date is more than 30 days from arrival, the refund for the reduced number of nights will be processed by the hotel within 30 days of you informing the hotel and no additional penalties will be incurred. In such event you are required to e-mail the details of the change to the relevant hotel for processing, failing which your refund will not be processed and the initial payment processed will reflect on your account at time of check in.
Should you reduce the number of nights stay within a 30 day period of your expected arrival date you will not be refunded.
7. Payment terms and conditions for bookings during all seasons - extension on nights stay
If you extend your original reservation online and prior to your check-in, The Company will take payment in respect of the additional accommodation charges at the time of check-in.
8. Confirmation of reservations
On confirmation of payment, you will be sent an e-mail. The e-mail address provided by you will be used to send the confirmatory e-mail. It is advised that you print the confirmatory e-mail and present same to The Company at time of check-in.
In the event of your reserved room not being available, or not being vacated by a previous guest, The Company will: either upgrade your reservation at the Resort or - reserve a room (and pay the difference in the room tariff, if any) and arrange transportation to another equivalent hotel for the duration of your reservation or until your original reservation can be fulfilled and supplied.
LEGAL DISCLAIMER
We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our website. Whilst every effort is made to ensure delivery of accommodation booked, The Company reserves the right to offer alternate accommodation should this be required in which case any price difference will be refunded or become payable upon demand. Once a Reservation is made you agree to all the terms and conditions applicable including those changes that have arisen and not yet published on this website.
Privacy Policy
We are serious about protecting the privacy of our users. This Privacy Policy describes how we use and protect your personal data. It applies to www.joyacyprus.com, any other websites of our affiliates where this policy is linked to in the footer of the page (each referred to herein as the “Site”), and any mobile application of such websites. Websites of other of our affiliates may be governed by separate privacy policies and those policies will be accessible by links in the footers of those websites.

The terms “users” or “you” as used in this Privacy Policy , refer to travellers, who use the Site to look for properties to rent (“Travellers”), to property owners, lessees and property managers (“Owners”) who list their properties for rent on the Site, and to other users who use software or other tools or services we provide on the Site.
We use information collected about you only as permitted in this Privacy Policy. The Site may contain links to third parties’ websites. We are not responsible for the privacy practices or the content of those websites. The Site may also contain links to terms and conditions and privacy policies of third party providers who provides tools or services on the Site. Therefore, please read carefully any privacy policies on those links or websites before either agreeing to their terms or using those websites. Unless we explain otherwise in this policy, the words and phrases used in this policy have the same meaning as the Traveller Terms and Conditions.
By providing information to us when listing a property, searching for a property, using any tool or service on the Site, sending inquiries or otherwise using the Site, you expressly agree to this Privacy Policy. This Privacy Policy was last updated on the date set forth above and applies from that date. We may occasionally amend this Privacy Policy to reflect regulatory requirements; advances in technology, Site updates and changes in our information collection and disclosure practices. We do not knowingly collect or process data from anyone under the age of eighteen (18) years old.
Who processes your personal data, and where?

Evergreen Developments Group sites may also use Google Analytics to gather statistics on site usage. This may involve the use of cookies. Google may aggregate data they collect form their various services including Google Analytics, Google Translate, Google Maps and YouTube. You acknowledge and accept that Evergreen Developments Group has no control over Google’s data collection. We strongly advise that you look at Google’s privacy policy for details of their data collection practices.
The information we collect
At various times you may give your personal data to us. For example, in order make a reservation, we may need to know all or some of the following: your full name, address, telephone number, e-mail address, your current location, and, in the case of completing a reservation, a method of payment. You may also give personal data to us at other times, such as when registering on the Site, when submitting an advertisement for a property or communicating with another user of the Site.
When you use the Site we may collect and process information about your actual location, including GPS signals sent by a mobile device. We may also use various technologies to determine location, such as sensor or IP address data from your device.
We may also gather information from cookies, web beacons or from the internet. You can find out more about how we do that in the relevant section of this policy below and in our Cookies Policy. We use publicly accessible information to verify information we are provided with and to manage and expand Joya Cyprus’s business. We also collect IP addresses, mobile device identifier details, your location, navigation and click-stream data, the time of accessing the website, properties you viewed, what you searched for, the duration of your visit, and other details of your activity on the internet. If you ask us to connect with other sites (for example if you ask us to connect with your Facebook account) we may get information that way too. In connection with electronic communications we facilitate through a Site, we use electronic or manual checks to monitor such communications for trust and security purposes. We obtain data from you either by you inputting your personal details, by the automatic collection of information about you as you use the Site, when we speak to you, or from third parties or websites. How we use your personal data

We also use demographic information to tailor the Site and we share that information with third parties so that they can build up a better picture of our customer base and general consumer trends; and
To help us meet our legal and compliance obligations – for example we may use personal data we hold on you to do background checks, to screen prospective Owners against official lists in the UK and overseas and to do credit checks.
How We May Disclose Your Personal Data
We may disclose your personal data to enforce our policies, to comply with our legal obligations or in the interest of national security, public interest or law enforcement in any country where the Evergreen Developments Group has entities or affiliates. For example, we may respond to a valid request by a law enforcement agency or regulatory or governmental authority. We may also disclose data in connection with actual or proposed litigation, or to protect our property, people and other rights or interests.
We share your information with third parties who help deliver our products and services to you. Examples include hosting our web servers, analysing data, providing marketing assistance, and providing customer service. These companies will have access to your personal information as necessary to perform their functions, but they may not use that data for any other purpose. We will remain responsible for any information shared in this way.
We may also share your personal data with:
Companies in the Evergreen Developments Group and/or affiliates;
Other companies we work with to feature all or part of our Joya Cyprus property listings or otherwise provide promotional or other services related to our or HomeAway Group’s business. This might include featuring your listings and photographs on other websites; or
Any third party you have asked us to share your personal data with – such as Facebook if you have asked us to connect with your Facebook account.
You may have accessed our website through a hyperlink from the website of one of our trading partners. If so, you consent to your personal details and purchase information, including behavioural patterns, being shared with that trading partner in accordance with our contractual relationship with them.
In the unlikely event that we or Evergreen Developments or any part of the Evergreen Developments Group is sold, or some of its assets transferred to a third party, your personal information, as a valuable asset, may also be transferred. Potential purchasers and their advisors may have access to data as part of the sale process. However, use of your personal information will remain subject to this Privacy Policy. Similarly, your personal information may be passed on to a successor in interest in the unlikely event of a liquidation, bankruptcy or administration. Our customer database could be sold separately from the rest of the business, in whole or in a number of parts. It could be that the purchaser’s business is different from ours too.
Newsletters
If you sign up on the Site, you will receive our Joya Cyprus newsletter, which is an integral part of the services we provide. Travellers that use the Site will receive our newsletter when they register with us. We and Evergreen Developments group may offer different newsletters from time to time intended to enhance the services we or they offer. Users may cancel their subscription to these newsletters at any time, although it may take a short while for the changes in your preferences to become effective.
Surveys
Surveys are another method by which we gather information about our users. From time to time, we request users' input in order to evaluate potential features and services. The decision to answer a survey is completely yours. We use information gathered from surveys to improve our services.
Mobile Applications
When you download or use apps relating to our websites, we may receive information about your location and your mobile device, including a unique identifier for your device. We may use this information to provide you with location-based services, such as advertising, search results, and other personalised content. Most mobile devices allow you to turn off location services. If you have questions about how to disable your device's location services, we recommend you contact your mobile service carrier or your device manufacturer.
Enquiries and other Electronic Communications
Travellers may send enquiries to Evergreen Developments group via the Site requesting information or via our automated channels.
If you choose to send an enquiry via a Site, your personal information, including your email address and any other information you supply (unless the Site specifies otherwise), will be visible to the Agent or representative so that they can reply directly to you. Enquiries sent using the Evergreen Developments group system are also available for review to a limited number of customer service employees, who may be asked by a property Owner or others for their past enquiry information.
If you engage in such communications you may be asked to leave a return telephone number. Do not share information in the e-mail or phone call that you are not prepared to allow such person and Evergreen Developments group to have, including, but not limited to, credit card and bank account information. Card details can be entered securely via our online payments system and as such need not be seen by any employee or representative of the Evergreen Developments group.
We may also from time to time, use third party e-mail servers to send and track receipt of such communications, and analyze the pattern of such communications for trust and security purposes as well as to gather data, such as enquiry and booking data (on an anonymous basis), to assist us in better understanding our business. Our system does not hold messages indefinitely and they may not be accessible after the message has been delivered to you. Please print a copy of any message which is important to you – for example a payment receipt or a booking confirmation.
How Do We Protect Your Personal Information Once We Have It?
We take appropriate technical and organisational measures to guard against unauthorised or unlawful processing of your personal data and against accidental loss or destruction of, or damage to, your personal data. While no system is completely secure, we believe the measures implemented by the Site reduce our vulnerability to security problems to a level appropriate to the type of data involved. We have security measures in place to protect our user database and access to this database is restricted internally.
However, it remains each user's responsibility:
To protect against unauthorized access to your use of the Site;
To ensure no-one else uses the Site while the user's device is logged on to the Site (including by logging on to your device through a mobile, Wi-Fi or share access connection you are using);
To log off or exit from Site when not using it;
Where relevant, to keep your password or other access information secret. Your password and log in details are personal to you and should not be given to anyone else or used to provide shared access for example over a network. You should use a password which is unique to your use of the Site – do not use the same password as you use for another site or email account;
To maintain good internet security. For example if your email account or Facebook account is compromised this could allow access to your account with us if you have given us those details and/or permitted access through those accounts. If your email account is compromised it could be used to ask us to reset a password and gain access to your account with us. You should keep all of your account details secure. If you think that any of your accounts has been compromised you should change your account credentials with us, and in particular make sure any compromised account does not allow access to your account with us. You should also tell us as soon as you can so that we can try to help you keep your account secure and if necessary warn anyone else who could be affected.
If you have asked us to share data with third party sites, however (such as Facebook) their servers may not be secure. Credit card information is generally stored by our credit card processing partners and we ask them to keep that data secure. We also use third parties to help us optimize our website flow, content and advertising (see below).
Note that, despite the measures taken by us and the third parties we engage, the internet is not secure. As a result others may nevertheless unlawfully intercept or access private transmissions or data.
What are Cookies, Web Beacons and Clear GIFs and Why Do We Use Them?
A "cookie" is a small file placed on your hard drive by certain of our web pages. We or third parties under contract with us may use cookies to help us analyse our web page flow, customize our services, content and advertising, measure promotional effectiveness and promote trust and safety. Cookies are commonly used at most major transactional websites in much the same way we use them here at our Site.

The property is strictly no smoking. Should any guest be caught smoking inside the apartment you will also be fined £50. This is to attempt to deal with the effects that smoking causes on furnishings and décor. I understand that if I wish to leave prior to my agreed departure date I will be charged for each night stayed in the accommodation. The minimum number of nights that will be charged is 2 nights. Damage, theft and excessive electricity/water usage will be charged in full (Daily allowance of 14Kw electricity and 250 litres of water per day per apartment)smoking cause on furnishings and décor.
